These Terms of Service ("Terms") govern your use of the website www.prevailedgeinsurance.com and the internal agent management application at admin.prevailedgeinsurance.com (the "Application"), operated by Prevailedge LLC ("Prevailedge", "we", "us"). By accessing or using them you agree to these Terms.

1. The Application

The Application is an internal tool for authorized Prevailedge insurance agents and staff to manage leads, clients, applications and appointments, including an optional integration with Google Calendar. Access is granted only to users to whom Prevailedge has issued an account.

2. Accounts

You are responsible for keeping your credentials confidential and for all activity under your account. Notify us immediately of any unauthorized use. We may suspend or terminate access at any time, including when an agent's relationship with Prevailedge ends.

3. Google Calendar integration

Connecting Google Calendar is optional and requires your consent on Google's consent screen. By connecting, you authorize the Application to read your calendars' events and to create and manage a dedicated "Prevailedge" calendar and its events in your Google account, as described in our Privacy Policy. You may disconnect at any time from the Application or revoke access at myaccount.google.com/permissions. Your use of Google services remains subject to Google's own terms and policies.

4. Acceptable use

You agree to use the Application only for legitimate Prevailedge business and to comply with applicable law, including insurance and privacy regulations. You must not: access data you are not authorized to see; share your account; attempt to disrupt, probe or bypass the security of the Application; reverse engineer it; or use it to send unlawful or unsolicited communications.

5. Client and business data

Data you enter or that is synchronized into the Application belongs to Prevailedge or its clients as applicable, and must be handled confidentially and only for the purposes of your work.

6. Intellectual property

The Application, its software, design and content are owned by Prevailedge or its licensors. You receive a limited, non-exclusive, non-transferable right to use it for authorized business purposes while your access is active.

7. Availability and changes

We may modify, suspend or discontinue any part of the Application at any time. We do not guarantee that it will be uninterrupted or error-free, nor that calendar synchronization will always be immediate or complete.

8. Disclaimer

The Application is provided "as is" and "as available", without warranties of any kind, express or implied, to the maximum extent permitted by law.

9. Limitation of liability

To the maximum extent permitted by law, Prevailedge will not be liable for indirect, incidental, special or consequential damages, or for lost profits, data or appointments, arising from the use of or inability to use the Application.

10. Termination

You may stop using the Application at any time. We may terminate or suspend access without notice for violation of these Terms or for security reasons. Provisions that by nature should survive termination will do so.

11. Governing law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules.

12. Changes to these Terms

We may update these Terms. Changes are effective when posted on this page; continued use means you accept them.

Estas Condiciones del Servicio ("Condiciones") regulan el uso del sitio web www.prevailedgeinsurance.com y de la aplicación interna de gestión de agentes en admin.prevailedgeinsurance.com (la "Aplicación"), operados por Prevailedge LLC ("Prevailedge", "nosotros"). Al acceder o usarlos, usted acepta estas Condiciones.

1. La Aplicación

La Aplicación es una herramienta interna para que agentes de seguros y personal autorizado de Prevailedge gestionen prospectos, clientes, solicitudes y citas, e incluye una integración opcional con Google Calendar. El acceso se otorga solo a usuarios a quienes Prevailedge haya emitido una cuenta.

2. Cuentas

Usted es responsable de mantener la confidencialidad de sus credenciales y de toda la actividad realizada con su cuenta. Notifíquenos de inmediato cualquier uso no autorizado. Podemos suspender o terminar el acceso en cualquier momento, incluso cuando finalice la relación del agente con Prevailedge.

3. Integración con Google Calendar

Conectar Google Calendar es opcional y requiere su consentimiento en la pantalla de Google. Al conectarlo, usted autoriza a la Aplicación a leer los eventos de sus calendarios y a crear y gestionar un calendario dedicado "Prevailedge" y sus eventos en su cuenta de Google, según se describe en nuestra Política de Privacidad. Puede desconectarlo en cualquier momento desde la Aplicación o revocar el acceso en myaccount.google.com/permissions. El uso de los servicios de Google sigue sujeto a los términos y políticas de Google.

4. Uso aceptable

Usted se compromete a usar la Aplicación solo para fines legítimos de Prevailedge y a cumplir la ley aplicable, incluidas las normas de seguros y de privacidad. No debe: acceder a datos que no esté autorizado a ver; compartir su cuenta; intentar interrumpir, sondear o eludir la seguridad de la Aplicación; aplicar ingeniería inversa; ni usarla para enviar comunicaciones ilícitas o no solicitadas.

5. Datos de clientes y del negocio

Los datos que usted ingrese o que se sincronicen en la Aplicación pertenecen a Prevailedge o a sus clientes, según corresponda, y deben tratarse de forma confidencial y solo para fines de su trabajo.

6. Propiedad intelectual

La Aplicación, su software, diseño y contenido son propiedad de Prevailedge o de sus licenciantes. Usted recibe un derecho limitado, no exclusivo e intransferible para usarla con fines comerciales autorizados mientras su acceso esté activo.

7. Disponibilidad y cambios

Podemos modificar, suspender o discontinuar cualquier parte de la Aplicación en cualquier momento. No garantizamos que funcione sin interrupciones ni errores, ni que la sincronización del calendario sea siempre inmediata o completa.

8. Exención de garantías

La Aplicación se proporciona "tal cual" y "según disponibilidad", sin garantías de ningún tipo, expresas o implícitas, en la máxima medida permitida por la ley.

9. Limitación de responsabilidad

En la máxima medida permitida por la ley, Prevailedge no será responsable por daños indirectos, incidentales, especiales o consecuentes, ni por pérdida de ganancias, datos o citas, derivados del uso o la imposibilidad de usar la Aplicación.

10. Terminación

Usted puede dejar de usar la Aplicación en cualquier momento. Podemos terminar o suspender el acceso sin previo aviso por incumplimiento de estas Condiciones o por razones de seguridad. Las disposiciones que por su naturaleza deban subsistir a la terminación lo harán.

11. Ley aplicable

Estas Condiciones se rigen por las leyes del Estado de Florida, Estados Unidos, sin considerar sus normas sobre conflicto de leyes.

12. Cambios a estas Condiciones

Podemos actualizar estas Condiciones. Los cambios son efectivos al publicarse en esta página; el uso continuado implica su aceptación.
